1. Application of these Terms

Introduction and definitions

These Terms apply to purchases through duffnall.com. Accessing the Website or placing an Order means accepting them. Website means duffnall.com; Goods means the apparel, accessories and related products offered there; Order means a request to buy Goods; We, Us and Our mean DuffNall Ltd; and You or Your means the customer, user or purchaser.

1.1 Scope

These Terms govern Website use and purchases. They may be updated, so review the current version regularly.

1.2 Data collection

Information about you and your activity may be collected. The Privacy Policy explains its handling and forms part of these Terms.

1.3 Contract

These Terms and the Privacy Policy together form the agreement between you and DuffNall.

2. Severability

If a provision is unlawful, void or unenforceable, it will be treated as separate and the remaining provisions will continue.

3. Audience and legal compliance

The Website is primarily for consumers, is provided in English and is developed under English law. Users accessing from another territory are responsible for considering local sales and advertising rules. Some areas may require completed registration.

4. Governing law and jurisdiction

English law governs these Terms and disputes are subject to the exclusive jurisdiction of the English courts.

5. Website intellectual property

5.1–5.3 Ownership and use

Website design, text, trade names, logos, graphics, software and other materials belong to DuffNall Ltd or its licensors. You may view and print pages only for personal, non-commercial use. Copying, distribution, modification, publication or commercial use requires prior written permission. DuffNall names, logos, slogans and marks—including Relentless in the Pursuit™—must not be used without consent.

5.4 Linking

DuffNall may require a link to the Website to be removed.

5.5 User content

Submitting reviews, photographs, video or other content grants DuffNall a non-exclusive, royalty-free licence to use, adapt, distribute and share it.

5.6 Third-party content

DuffNall does not guarantee the accuracy or suitability of embedded or third-party content; reliance on it is at your own risk.

6. Website liability

Website information is intended to be accurate and useful but is not guaranteed complete, reliable or professional advice. Content may change without notice. External links are supplied for convenience and are not controlled or endorsed by DuffNall. Uninterrupted, error-free or virus-free access cannot be guaranteed. Product colour and appearance can vary from screen images. Purchased Goods will conform to the sales contract formed under these Terms.

7. Acceptable use

Defamatory, abusive, obscene, unlawful, sexist, racist, offensive, threatening or harassing material and behaviour are prohibited. Information supplied must be accurate, current, truthful and your own; do not impersonate another person without authority. DuffNall may remove material, restrict features or ban users who breach these rules.

8. Orders and contract formation

8.1–8.7 Acceptance and structure

Adding to cart, checkout and payment authorisation show an intention to buy but do not guarantee acceptance. A sales contract forms only when Goods are dispatched. An Order may contain several items, but each Order is a separate contract. DuffNall may refuse supply. Customer-requested changes apply only when expressly agreed.

8.8 Ordering journey

• Choose Goods and add them to cart.
• Review products, quantities and valid promotional codes.
• Provide accurate customer and delivery details.
• Select delivery and payment methods, review the summary and submit the Order.
• An acknowledgement screen and email confirm receipt after payment authorisation.

8.9–8.12 Refusal, checks and limits

An Order may be refused or cancelled for incomplete or unauthenticated payment, incorrect description or price, failed eligibility, suspected fraud or security concerns, missing details or unavailable stock. DuffNall may verify an Order by phone or email. Goods are for personal consumer use unless consent is given, and an Order value may be limited or adjusted.

9. Pricing, payment and verification

Accepted prices include VAT, are in pounds sterling and show delivery separately. Prices and promotions may change or be withdrawn. Full payment is due before dispatch. Methods include PayPal, Visa, Mastercard, Maestro, American Express and, where available, WeChat Pay, Alipay and UnionPay. You must be authorised to use the payment method, and provider security and authorisation checks apply. DuffNall is not responsible for provider fees. If stock is unavailable, DuffNall will notify you and cancel or refund within 30 days without compensation. Order information may be checked using commercial records, credit-reference services and registered agencies; placing an Order confirms consent to those checks.

10. Returns and faulty Goods

10.1 Standard returns

You may cancel within 14 days after delivery without giving a reason. Notify DuffNall by email, post or phone and return within 30 days of cancellation by recorded delivery or courier. You pay return postage and a 10% restocking fee applies. Goods must be unused, in good condition and in original or suitable replacement packaging. The purchase price and standard delivery charge, where applicable, will be refunded within 28 days after receipt of the Goods or proof of postage. Partial returns may not receive a full delivery refund. Personalised and custom Goods cannot be returned.

10.2–10.6 Faults and processing

Faulty Goods must be returned within 30 days of receipt for inspection. A confirmed fault will be replaced or refunded and DuffNall will cover return cost. Normal wear, accidental or deliberate damage, negligence, misuse, unauthorised alterations or repairs are excluded. Use tracked delivery and keep proof; DuffNall is not responsible for return-transit loss or damage. Refunds and replacements are intended within 30 days of receipt. Suspicious activity may be verified and fraudulent returns refused.

11. Limitations of liability

Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or removes statutory consumer rights. DuffNall is not responsible for unforeseeable loss, misuse, natural wear or damage after delivery. Some fashion items may not suit intense sport, so assess intended use. To the fullest extent permitted, DuffNall excludes indirect, incidental or consequential loss, business loss and disruption outside reasonable control.

12. Delivery and risk transfer

Working-day delivery dates are estimates and exclude weekends and bank holidays. Updated estimates will be emailed where possible. Out-of-stock items will be notified and may have alternatives; one Order may arrive in separate deliveries. Ownership and risk transfer on delivery. Report incorrect or incomplete Goods immediately and do not use them before contact. Supply a valid address; DuffNall selects a suitable carrier method and may authorise delivery to a neighbour or safe place. Report non-delivery within 30 days of the expected date. Carrier restrictions may prevent international delivery and can require cancellation and refund.

13. Goods intellectual property

Designs, trademarks, brand names, imagery, logos and other rights connected with the Goods belong to DuffNall or its licensors. Purchase transfers no ownership or usage right. Unauthorised use, copying or distribution may result in legal action.

14. General

DuffNall is not responsible for failure caused by circumstances beyond reasonable control, including natural disaster, fire, trade dispute, supply-chain disruption or terrorism. You may not transfer contract rights or obligations without written consent. DuffNall may assign or appoint assistance without reducing its obligations. Invalid clauses do not affect the rest; delay in enforcing a right is not a waiver. English law and courts apply. Published changes take effect for Website use, while an existing Order remains under the version applying when placed unless expressly agreed. Rights that law protects remain.
